Incompatibility of Vietnam's legislation and practice on non-recognition of foreign arbitral awards

According to the domestic validity's principle, awards of foreign arbitrators have legal binding force only within the territory where they were declared. thus, in order for an arbitral award to be or not be recognized in another country, the award debtor has to request the foreign court to not recognize and enforce it. Non-recognition foreign arbitral award are restricted to certain and limited circumstances. Regarding this issue, Vietnam is a member of the New York Convention 1958 on the recognition and enforcement of foreign arbitral awards. However, our domestic legal provisions are still inconsistent with the Convention as well as international practices and causing the remarkable rate of non-recognition of foreign arbitral wards in Vietnam. In this paper, the author will analyze the reasons for Vietnam's legislation incompatibility with the New York Convention as well as the adjudication practice in non-recognition of foreign arbitral awards and propose solutions to remedy this issue.
